Abstract:
Based on the 1898 joint resolution of annexation, Governor Lingle is asking the U.S. Supreme Court to affirm that the State of Hawai?i has good title to Ceded Lands and that Native Hawaiians have a moral but not a legal claim to these lands. There are those who oppose and those who agree. But what are Ceded Lands? Why do issues about Ceded Lands revolve around the illegal overthrow of the Hawaiian Kingdom government and the annexation of Hawai?i to the United States?
David Keanu Sai, Ph.D. in political science, has done extensive research on this topic. Drawing from his recent doctoral dissertation and law journal article written last year, he presents a historical and legal context that show there are no "Ceded Lands."
