Mahele Award & Native Tenant Rights Protection Council

Aloha,

My name is Shelley Maka'ala Nakoa Kuakahela Mahi. I am of the Ha'I Ohana. I am assisting Uncle Abel @ Kawa'a and Kawa'a is under siege again. Ed Olson is trying to take Kawa'a in a Federal Court Case that may take place Feb. 14th, 2011. Ed O. is calling the Native Tenants claim to Kawa'a "Frivolous" and is trying to charge the family $5,000 each to the Native Tenants for Personal Injury....and of course their removal. Turns out, I have gone over the Mokuauhau for the Ohana and Abel Lui is related to Timoteo Keawe whose grant is Helu 993 and 1530. He has every right as a Native Tenant. On top of that, Allodial Title "Codifies" a Constitutionally protected native Hawaiian Act. (See State of Hawaii v. Hanapi case)and that Criminal Tresspassing is dismmissable based on a Constitutional Rights Violation based on Allodial and Cultural stewardship and restoration. Also the use of Excessive Force to remove the Hawaiian kanaka from their own land which is Allodial or "Alodio" as KKIII said. I want everyone to know that the Police Department atleast in the County Of Hawaii has what they call a "No Continuum" policy which means they have no step 1,2,3 for arrest or handcuffing and they leave it up to the Police Officer as when to jump into Excessive Force----which may be why one hawaiian man got tasered three times going on his own property that someone else "bought" and also why every time the Community Development Plan folks don't want to hear about "Native Tenant Rights" people are hauled off by the Cops and get their arms twisted or worse. Also, which came as a shock, the Police Force is NOT ACCREDITED! They admitted at a meeting that they are 6 months into their Accredication Process and that then they'll be "Up to National Standards"---see "Pahala Community Meeting the County of Hawaii Police Department Minutes Area 2"...so what that means to me is that the Hawaiians are dealing with a non-accredited Police Force in a non certified Local Government. People on the Streets and even OHA stated that that amounts to a "Malitia"...

On top of that, Title Guaranty has been caught signing dead peoples' signatures on to MAHELE TITLES.....title issues go all the way back to 1896 if not before. The Police Investigation report #M100-52330....full report due to OHA and the "White Collar Crime Squad"..If you have had dealing with TG or you land ripped off because of TG please send a Notarized Report...Please write to:

View, HI. 96771 ....Because the forgery was allowed by a State of Hawaii Judge and every act by a judge is an act by the state///the State of Hawaii is guilty of violating the "Conditions of Statehood" and the Admissions act which states: "The State of Hawaii must uphold their Judicial responsibity to the Hawaiian People to protect their Culture and Religion so that the Hawaiians DO NOT DIMINISH"..."If the State of Hawaii is derelict in their duties Congress can sue the State of Hawaii and Remove their Statehood (!)" they are already in non-compliance and have pending Human Rights Violations under Geneva IV...see pending UN Official Inquiry launched by other countries at the cry of Hawaiians...against the State of Hawaii.

......and that T.G. has a Corporate Training Packet that I received in the mail from an unkown source...that tells their employees to "Delete Native Tenants" exceptions from the titles before the Report goes out to the Client. They encourage the fencing of properties to cause "Criminal Tresspass" and "Anti-PASH" measures. Title Guaranty is also denying knowledge of the 381 Parcels of Queen Liliuokalani held by DBEDT and the Land Commission. These parcels are all "Altered Documents" with the Queens name crossed out and Doles name scratched in. 1 sheriff and 2 "officers" stated it is a criminal act and anyone selling them could be arrested. It is also forensic evidence related to the Overthrow. Relatives can go claim these parcel right know under undivided interest, etc. anyway.....be watching fot the Kawa'a case and the upcoming Protest about the Kunia Project. Love all Y'all.....don't ever give up, don't be apathetic, and remember God/Keakua is on your side...plus you have a Legal Leg to stand on because all the titles are still good. sorry for misspellings....love you all! I do not wish to offend you or anyone else for that mater and I would like to apologies in advance if I do.

However I must speak out on my mothers behalf and the for rest of my family. I have to disagree with your statement in your article about Abel Lui (Simeona) which you stated; ?Turns out, I have gone over the Mokuauhau for the Ohana and Abel Lui is related to Timoteo Keawe whose grant is Helu 993 and 1530. He has every right as a Native Tenant.? My mother who is a blood relative of the Timoteo Keawe or other wise known as Kimokeo, has spent years in doing research on the genealogy of our family. In her research she has looked for the relation between Abel and Timoteo or Kimokeo family. She has never found any proof that he is in fact related to the Timoteo Keawe family. His clam to the said grant 1530 is not a valid clam!
Again I do not wish to create any kind of hakaka with anyone but I do wish to stand up for my families right so that all the work my mother has gone through to ensure this land stays with in the rightful family will not have been in vain.

Aloha Everyone,

I wanted to let folks know that I am a Mixed breed American who is part American Indian, and other breeds. My Hawaiian name was given to me after my daddy died and it was an honor to receive it from a Hawaiian Kupuna. After I was also lovey hanai by Aka Mahi so I have a new Hawaiian name to ad I s'pose. But I guess if I was just an orphan and was namelss I would still want to help the Hawaiians. t this time I have been given over five names all in Hawaiian. My blood family name is related to Ha'I. Maybe my Ohana out there from Honolei will someday contact me, maybe I am Your cousin. Anyway, I am a Stephens/Stevens, but not directly related to Prime Minister Stevens that overthrew the Queen. I am not trying to mislead or lie to anyone. I am sorry the Hawaiians are going through so much and many of us Americans seek to help; we have to whether we may know what to do or not. I am sorry if I make mistakes on the way....people like flowers come in all colors.....
but remember that in the Kumulipo (Hawaiian creation chant)there are "White skinned" people. I don't worry about that anyway at this point because the Hawaiian Kingdom was made of all types of races of people and the Kanaka was the host culture. Aloha Everyone,

Well, it has been vey interesting seeing first hand what the Hawaiians are up against in trying to keep their lands. I wanted to give an update to let folks know a few things. I was able to do more research and it turns out the in Okuna's so-called "Quiet Title" on page 4- for Kawa, that the NAtive Tenant Rights are included in the deal.
Because Abel and his family, including all the Timoteo Family, all have the right to their land.
the problem is, some officials do not seem to know what the difference between a Squatter and a Native Tenant. I was raised on the Mainland and this story is almost the same for the Native American Indians....except as they told my Great Grandmother, "You have to be a human being to buy land." But the Hawaiians, even though they are allowed to buy back their land and are considered by others "more human" unlike the label they put on the Indians; why should the Hawaiians have to buy back something they already own? I am also very upset about the bad deal the County gave the Apiki, Napoleons, et al by swindling them out their land through a raw deal called the "Basil Apiki PASH lineal Descendant Rights" to the Kawa Bay/Beach Area. This term came from the deal for Hilea when the Attorneys sought to take 25% of Hilea for their fees. This "PASH Lineal Descendants Rights" is Bogus! You must understand we ALL have PASH rights=Public Access Shoreline Hawaii" Since we all have PASH rights for ACCESS-then what does that have to do with actual TITLE and BIRTHRIGHT of the Heirs? I want to let folks know their is enough evidence to call for a new trial and to render void the previous unsound and unethical deal made to take the interest away from the Hawaiians. Anyway, another deal is that:
1. Okuna never had any title that was warranty type until he had someone make it.
2. Waihino Dreams cannot convey the land to itself as they are not even a legal business.
3. No one person with undivided interest can sell out everyone else's interest.
4. Though they may or may not get along, Abel Lui and Ohana are related to Timoteo Keawe, the Moa's, the Napoleons et al. fot ther is an undivided interest issue.
5. In the land of Hilea-who called out the Heirs of Kamehameha?

Aloha, Moa is also the Ohana of the Kauwe Ohana. I do know where the Moa come in to the line of the Apiki Ohana. The 14 Ohana that recieved this Mahale from the Kamehameha brothers where related to them.

There is 14 Ohana that Kamehameha V deed to the Kamehameha Heirs. Moa is one descended of these 14. And Abel is not one of the heirs belonging to this genealogy. He doesn't care about our iwi bones that is buried there. Like Aunty Pele Hanoa said in court he is not from that Ahupuaa. He is a Native Tenant, but shouldn't the right people have that right in there own aina.

It seems that county ?oslon and apiki are aware of The 2.5milon dollar common law lien on the 993 and 1530.filed by Abel auntie.Abel tutu is pelapela who married Keawe in 1790.pelapela also known as kaiwi or kumooa also known as timoteo.did u know by the county and oslon trying to steal land that has acommon law lien file 1986.it's the most superior equity lien.and that the case from Kona court .oslon vs Lui as been remove to federal court.apiki set up John omerod trust for kawa.only clear fee title can U have legal trust where trusts get money from somewhere.donations.hmm!!sounds like they have all broken the law.

It's a shame to she how hard it has become for the families that rightfully belong to this ahapuaa to just go down to kawa and Kaalaiki. The bickering needs to end already, if Able can prove that he is ?related? to the Apikis and the Napoleons then let his show his Pala! End all of the arguing, stop talking about it?.

If he cant or wont than that is saying a lot. Because I know for a fact that the Apices and the Napoleons have there pala pala all together and can show ware they come from?.

I think the information you stated is false about the POlice force, being accredited only means that the Police Department is elligible for government grants that's all it does not in any way mean that the Police here are a Militia force as you state and by the way who from OHA said that? I would surely like to know. Being a native Hawaiian I do feel that Hawaiians are deemed certain land rights but please do your homework when stating things that aren't true makes us Hawaiians look bad, by the way I know your not Hawaiian simply living in Hawaii doesn't make you Hawaiian on my birth Certificate it states Hawaiian does yours? First off i would like to clarify the fact that the correct spelling of this area is Kawa not kawa'a. just because canoes landed there doesn't mean that the name should resemble thus. Second, the fact that you claim Abel is protected based on allodial cultural stewardship and restoration is BOGUS. He has yet to provide genealogical ties and I've been to Kawa and it sickens me to see how mistreated the house sites are. if you consider ancient rock walls destroyed and tin roofed shacks put in its place and abandoned cars and clothing scattered around the brush restoration then i would hate to say it but you have been well misinformed and havent a clue what restoration is actually about. also to clarify a few things for you about your post on May 14 2011 "Kawa Update"

PASH is defined as cultural and religious practices of our native people e.g. gathering rights of native plants, fishes, and minerals and religious practices at sites or burial grounds.
The PASH Lineal Descendants Rights case is somewhat in the same category but also covers and preserves archaeological sites at Kawa Bay that could ultimately be ruined if left as is under its supposed current care!!

And finally i would like to say please have more respect for our ali'i and not call him KKIII.
